Does the Consumer Protection Act apply to every residential lease?

The Consumer Protection Act governs transactions between a supplier acting in the ordinary course of business and a consumer. A landlord who lets residential property as a business — or an agency letting on their behalf — is generally a supplier for these purposes.

The Act does not apply where the consumer is a juristic person whose asset value or annual turnover equals or exceeds the threshold set by the Minister. Below that threshold, and for every natural-person tenant, the Act applies.

This matters because the fixed-term protections in section 14 — the 20 business day cancellation right, the 40-to-80 business day expiry notice, and the automatic month-to-month continuation — apply only to agreements the Act covers. Section 14 also does not apply to transactions between two juristic persons regardless of turnover.

Where the CPA does not apply, the lease's own terms and the common law govern the notice period, which is why the notice terms recorded against each lease matter as much as the expiry date.

The Rental Housing Act 50 of 1999 applies to residential leases more broadly and is not displaced by the CPA — the two operate together.
